Over $30,000 Collected for Association by Defaulting Bank

A condominium Association filed a foreclosure complaint against an owner for failing to pay the regular maintenance fees and assessments.  Kaman Cusimano successfully obtained a judgment against the owner and also defaulted out a bank that held the first mortgage on the real estate, meaning that the Association’s lien had priority over the first mortgage .  In response to a payoff, Kaman & Cusimano successfully collected over $30,000 from the bank defaulted out before the Sheriff sale.
