Successfully Defended Fair Housing Claim where Owner Alleged Association Failed to make a Reasonable Accommodation.

A unit owner requested that the association remove a sloped sidewalk on the exterior of her unit to accommodate her disability.  The association obtained several estimates and were advised by their contractor that a step or ramp must be installed.  The owner refused as an acceptable accommodation and filed a fair housing complaint.

Kaman & Cusimano successfully defended the fair housing claims by showing that the Association made offers to the owner and interactively engaged in the accommodation process and that the owner failed to provide a viable alternative to the association’s offers.
